La Resolución se ampara en lo dispuesto por el Decreto Supremo (DS) 3443 de 2017 que establece que ante un riesgo de abastecimiento interno y precio justo ambos ministerios emitirán certificaciones; al mismo tiempo y con esta acción el DS 3443 abroga los artículos de tres decretos referidos a cupos de carne bovina: DS 1163 de 2012, DS 1637 de 2013 y DS 2489 de 2015, así como crea un Comité de monitoreo y abastecimiento de carne bovina. Este Comité estaría compuesto por los dos ministerios y el OAP, y tendrá como funciones determinar anualmente el déficit o superávit entre oferta y demanda; determinar semestralmente la asignación de cupo de exportación de cada empresa; recomendar el volumen de exportación autorizado para cada empresa que figure en su certificado; y emitir sanciones en el marco del monitoreo que debe realizar el Viceministerio de Comercio Interno a través de la Aduana.
